FACTUAL, whose aim is to establish the TRUTH in the Lundy murders, was formed following the incarceration of Mark Lundy. It consists of a team of experts and concerned citizens from throughout New Zealand, who believe that the guilty verdict is unsafe.

The FACTUAL team have viewed the programme from the investigator series screened on TV1 on Wednesday 17 June 2009.

We acknowledge Mr Bruce’s efforts to review the case and are once again grateful to have it back in the public arena creating healthy debate in our countries lunch rooms. We are however concerned that, by Mr Bruce’s own omission, he has recreated it from the original trial documents and police theories. His programme, although dubbed the investigator, was based primarily on the same incomplete and misleading evidence presented to the original jury.

It is enlightening to note that Mr Bruce did however arrive at the same conclusion as FACTUAL. The murders were in fact committed on the morning of the 30 th August. This is not new evidence! Details outlining this fact have been on the lundytruth.com website for 8 years.

Available documents also show that the police did consider this timeframe, but opted not to proceed with a prosecution on this basis.

Mr Bruce has only verbalised what we always knew – The police simply got this and other matters wrong!

Mr Bruce further stated he believes that Mark Lundy deserves a retrial based on a 2am timeframe. However, contrary to his opinion, in a 2am timeframe, nothing else fits. FACTUAL would therefore welcome an opportunity of a retrial on this basis.

The programme also shows a number of other inaccuracies. However, there are only two real issues left to consider.

The first – Was it really Christine’s brain tissue?

You may note from Mr Bruce’s programme that Dr Miller at no time tested the matter as being Christine’s. All he stated was that it “he was 100% sure the matter was brain or spinal tissue”. Dr Miller also stated on oath that he obtained similar results from a chicken’s spinal tissue.

Secondly the most asked question is - “if not Mark then who?

Many suspects were not eliminated from the case. Some, incorrectly or prematurely, based on the incorrect time of death. The original jury requested a list of other suspects during deliberation. The Court denied them access to this information.

Any opinions of Mr Bruce and RedSky TV are simply that – opinions – they offered no more evidence that Lundy actually travelled to Palmerston North at 2am on the 30 th of August, quite simply because there is none.

Factual furthermore believes the programmes recreations of the police theory were unnecessarily gruesome and served little purpose other than to hype up yet another theory bringing further grief to the victims of the Lundy and Weggery families and friends, who have suffered enough trauma. FACTUAL feel deeply for these victims and hope the truth will prevail quickly so we may all put this behind us as soon as possible.

Despite our serious misgivings about the content and lack of supporting evidence in this programme, we welcome the opportunity to have the plight of Mark Lundy brought to the forefront of people’s attention. At the very minimum it continues to stimulate healthy debate and informed discussions.

We further understand that another of Mr Bruce’s series will review other inadequacies of the justice system and the judiciary. In particular the Appeal court. We hope this episode will also continue to stimulate not just debate but corrective action.
